Windermere to discuss boathouses at attorney-client session

Town leaders will meet with their town attorneys at 7 p.m. Tuesday, Sept. 10.

The town of Windermere will host an attorney-client session to discuss the boathouses pending litigation at 7 p.m. Tuesday, Sept. 10, at Town Hall. 

Town representatives said the purpose of the session is to allow the town attorneys to seek advice from members of the Town Council, which will be confined to settlement negotiations and strategy related to the lawsuit. 

The meeting will include only Windermere Mayor Jim O'Brien; Town Council members Mandy David, Tony Davit, Brandi Haines, Tom Stroup and Andy Williams; Town Manager Robert Smith; and Town Attorneys Tom Wilkes, Nick Dancaescu, Summer DeGel and Rick Mitchell.

According to official court documents, the lawsuit was filed by the town of Windermere July 15, 2022, in the Orange County Circuit Courts at the Orange County Circuit Courthouse. Daniel and Anne Fanelli are listed as the defendants and counter plaintiffs.

The town previously hosted its first attorney-client session in February

The litigation most recently was brought up at the August Town Council meeting, where the boathouse owners presented a settlement offer giving the town 45 days to respond. The offer expired on Thursday, Aug. 15, and the owners said they received no response from the town.
